Vendors of copy machines must affix a warning label stating that deleting files does not erase them from the hard drive and recovery is possible if not disposed of properly.

Vendors must provide customers with information on how to install software that completely erases all data from copy machines, unless the manufacturer already provides such support services.

Copy machine vendors must destroy all records stored on machines in digital or other memory by erasing or modifying them to be unreadable and non-recoverable through generally available means when machines are sold, leased, or purchased.

Financial institutions must implement written policies to ensure copy machine hard drives or memory are erased, encrypted, or destroyed before machines are returned to leasing companies, sold, or disposed of.

Willfully removing, altering, or rendering illegible required warning labels is prohibited, and persons damaged by violations may recover punitive damages in addition to other relief.
