SPB 7062 - Rulemaking Summary

• Expedites rulemaking for the Department of Health and Agency for Health Care Administration by allowing website posting instead of Florida Administrative Weekly publication for notices and rules.

• Requires these agencies to submit a report to the Governor and Legislature if proposed rules implementing legislative acts don't become effective 30 days before the next session or within 6 months, whichever is shorter.

• Exempts the Department of Health and Agency for Health Care Administration from requirements to hold workshops throughout the state, allowing them to schedule workshops 7 days after website notice with toll-free conference call access.

• Authorizes agency designees (rather than only the agency head) to approve proposed rules and allows deputy secretaries to approve rule filings for these two agencies.

• Creates a presumption against standing to challenge rules for persons who cannot show attendance at hearings, workshops, or submission of written comments during the rulemaking process.
