CS/CS/HB 3: Electronic Gambling Prohibition and Community Protection Act

• Transfers regulatory authority over game promotions from Department of Agriculture and Consumer Services to Department of Business and Professional Regulation.

• Prohibits charitable and nonprofit organizations from operating game promotions and requires raffles conducted by such organizations to exclude electronic or mechanically operated devices controlled by the organization and operated by entrants.

• Defines "slot machine or device" to include systems or networks of devices used in games of chance, with a rebuttable presumption that devices displaying games of chance linked to payments or donations constitute prohibited slot machines.

• Establishes violations of game promotion and raffle provisions as deceptive and unfair trade practices and increases penalties for violations, including felony charges for use of prohibited electronic devices in game promotions.

• Amends racketeering activity definition to include violations related to gambling, lotteries, gambling devices, and slot machines under Florida RICO statutes.
