Requires jury recommendations for death sentences in capital felony cases to be unanimous, effective for offenses committed on or after October 1, 2012.

Applies the unanimous jury requirement to both capital felonies under section 921.141 and capital drug trafficking felonies under section 921.142.

Clarifies that courts may impose a death sentence notwithstanding a jury's unanimous recommendation, after weighing aggravating and mitigating circumstances.

Requires courts imposing death sentences to provide written findings of fact within 30 days, or the sentence defaults to life imprisonment without parole eligibility.

Takes effect October 1, 2012.
