CS/HB 267 Summary

• Codifies and revises the charter of the East Naples Fire Control and Rescue District in Collier County as an independent special fire control and rescue district.

• Establishes a five-member board of fire commissioners elected by district voters for 4-year terms, with authority to establish, equip, and operate fire and rescue services within the district.

• Authorizes the district to levy ad valorem taxes up to 1.5 mills (previously approved by referendum), issue bonds, charge impact fees, and manage district finances in accordance with Florida Statutes chapters 189 and 191.

• Provides detailed district boundaries and annexation procedures, including provisions that annexed property is removed from the district as of January 1 if annexed between January 1 and July 1, or assessed for that year if annexed after July 1.

• Grants the district powers to exercise eminent domain for fire station acquisition, promulgate fire prevention rules, establish planning requirements, and provides immunity from tort liability under Florida law.
