CS/CS/HB 337 Summary

• Creates section 287.05712 establishing a comprehensive framework for public-private partnerships (P3s) to develop and operate public-purpose facilities including educational facilities, water/wastewater infrastructure, transit, ports, and medical facilities.

• Requires responsible public entities to adopt guidelines with reasonable criteria for project selection, procurement procedures, financial review standards, and creation of oversight committees before considering any P3 proposals.

• Mandates private entities submit detailed proposals including topographic maps, project descriptions, financing plans, fee structures, and permits; public entities must conduct independent cost-benefit analyses before and after procurement.

• Establishes interim and comprehensive agreement requirements covering bonds, insurance, inspection procedures, maintenance standards, fee regulations, and termination/default procedures; facilities must ultimately be owned by the public entity.

• Takes effect July 1, 2012, and preserves sovereign immunity for public entities and local governments while requiring compliance with professional services procurement standards.
