CS/CS/HB 475 - Blood Establishments Summary

• Redefines "blood establishment" to include mobile units; defines "volunteer donor" as a person who receives only incentives (not remuneration) for blood donations meeting federal labeling standards.

• Prohibits local governments from restricting blood establishments' access to public facilities based on for-profit or not-for-profit status, and prohibits blood establishments from basing service fees solely on customer organizational status.

• Requires blood establishments collecting volunteer donations to disclose on the internet: collection/processing procedures, annual blood component statistics, conflict-of-interest policies, and financial statements (Form 990 or audited financial statements).

• Authorizes Department of Legal Affairs to assess civil penalties up to $10,000 per year for non-disclosure, with penalties deposited into the General Revenue Fund; allows penalty waiver for good cause.

• Exempts certain blood establishments from prescription drug manufacturer permitting requirements; allows blood establishments holding restricted distributor permits to distribute specific prescription drugs (bleeding/clotting treatments, blood derivatives, collection containers) to health care entities.

• Effective date: July 1, 2012.
