CS/HB 621 - Summary

• Clarifies that nursing home resident transfer and discharge procedures are governed by nursing home law (s. 400.0255), not landlord-tenant law.

• Removes several application requirements for nursing home licensure, including signed affidavits about financial interests, bed counts, civil verdicts/judgments, and quality assurance plans.

• Makes financial and ownership interest disclosures available upon request by the Agency for Health Care Administration rather than mandatory application requirements.

• Expands respite care services and eliminates additional licensure requirements for facilities providing respite care and adult day services.

• Allows facilities to charge reasonable fees for copying resident records ($1 per page for first 25 pages, 25 cents per page thereafter) and increases the remuneration exemption threshold from $10 to $15 for items given for promotional purposes.

• Repeals the Medicaid "Up-or-Out" Quality of Care Contract Management Program (s. 400.148) and makes various technical amendments to conform cross-references.

• Effective date: July 1, 2012.
