CS/CS/HB 751 Summary

• Revises the definition of "addiction medicine specialist" to include board-certified psychiatrists and expands recognized certification entities to include the American Board of Medical Specialties.

• Redefines "chronic nonmalignant pain" to exclude rheumatoid arthritis and adds "board eligible" physician category for anesthesia, physical medicine, rheumatology, and neurology specialists with 6-year residency completion.

• Permits board-eligible and board-certified physicians in pain medicine to own pain-management clinics without registration, and allows physician multispecialty practices to operate clinics if they include at least one board-eligible or board-certified pain medicine specialist.

• Exempts distribution of prescription drug active pharmaceutical ingredients for incorporation into finished dosage forms from permit requirements if distributor maintains valid state licensure and complies with recordkeeping requirements.

• Authorizes intracompany sales of prescription drugs between out-of-state and in-state wholesale distributors operating under the same business name without permits, provided recordkeeping and pedigree requirements are followed; effective July 1, 2012.
