Carl Abbott, age 67, was struck by a Palm Beach County School District bus on June 30, 2008, while crossing in a designated crosswalk, suffering closed-head injury, traumatic brain injury, subdural hematoma, and subarachnoid hemorrhage.

The Palm Beach County School Board is authorized to appropriate $1,900,000 total, payable in annual installments of $211,111.11 from fiscal years 2012-2019 and $211,111.12 in fiscal year 2020, to David Abbott as guardian of Carl Abbott.

Payments shall cease upon Carl Abbott's death, but David Abbott is guaranteed a minimum payment of $633,333.33 if Carl Abbott dies within 3 years of the act's effective date.

Attorney's fees, lobbying fees, costs, and similar expenses are capped at 15 percent of the first $1,000,000 and 10 percent of the remainder, totaling $240,000 maximum.

This award provides sole compensation for all present and future claims against the Palm Beach County School District arising from the injuries described in the act.
