North Broward Hospital District appropriates $2.8 million to Kristi Mellen as personal representative of the Estate of Michael Munson for wrongful death resulting from hospital negligence on September 21, 2008.

Michael Munson died of a heart attack after a triage nurse misdiagnosed his symptoms as an anxiety attack and twice sent him to the waiting room, violating the hospital's Chest Pain Protocol.

Total compensation of $3 million includes $200,000 already paid by the hospital under Florida Statute 768.28 statutory limits plus the $2.8 million authorized by this act.

Attorney's fees, lobbying fees, and costs are capped at 15 percent of the first $1,000,000, 10 percent of the second $1,000,000, and 5 percent of the remainder, totaling a maximum of $290,000, with taxable costs collectable separately.

The payment serves as sole compensation for all present and future claims arising from Michael Munson's death and takes effect upon becoming law.
