Litigants required to electronically file documents in Florida state courts, the Division of Administrative Hearings, or the Office of the Judges of Compensation Claims must pay a surcharge of 3.5 percent of the electronic filing cost if they file paper documents instead.

The surcharge applies in addition to any other filing costs already incurred by the litigant.

Indigent litigants as determined by Florida Statutes section 27.52 are exempt from paying the surcharge.

The act takes effect July 1, 2012.
