HB 1049 Summary

• Increases cigarette surcharges by weight and length: 5 cents per cigarette (≤3 lbs per 1,000), 10 cents (>3 lbs and ≤6 inches), and 20 cents (>3 lbs and >6 inches)

• Raises surcharges on small packages (≤20 cigarettes): $1/$2/$3 for packages of 10 or fewer, and $2/$3/$5 for packages of 11-20, depending on cigarette category

• Establishes a fee rollback account in the Highway Safety Operating Trust Fund to hold $1 per package (or 50 cents from smaller packages) from surcharge revenue

• Directs fee rollback account funds exclusively for the Legislature to incrementally rollback fee increases enacted in chapter 2009-71, Laws of Florida, subject to Florida Consensus Estimating Conference certification

• Takes effect July 1, 2012
