CS/CS/HB 1173 - Criminal Gang Prevention

• Enhances criminal penalties for trespassing in school safety zones (500 feet of school property) by persons previously convicted of gang-related offenses, making it a first-degree misdemeanor instead of second-degree.

• Creates enhanced penalties for recruiting or causing a person under 13 years of age to become a gang member, making it a second-degree felony with a first-degree felony penalty for repeat offenses.

• Authorizes county and municipal detention facilities to designate personnel to assess whether inmates are gang members or associates and requires biweekly reporting of gang-affiliated inmates to arresting law enforcement agencies.

• Assigns offense severity rankings for gang recruitment violations under section 874.05 in the Criminal Punishment Code sentencing guidelines.

• Revises sentencing multiplier criteria for gang-related offenses to apply a 1.5 multiplier to sentence points, but prohibits applying the multiplier if it would result in a sentence exceeding the statutory maximum for the primary offense.
