HB 1303 - Pregnancy Confidentiality Act

• Creates the "Pregnancy Confidentiality Act" to protect client records at pregnancy resource centers from unauthorized disclosure.

• Defines pregnancy resource centers as organizations that provide pregnancy counseling as their primary purpose and do not provide or refer clients for abortions or contraceptive drugs or devices.

• Prohibits disclosure of client records without written consent or request from the client or their legal representative; client records include names, contact information, identification numbers, employer information, and health-related information.

• Establishes violation as a first-degree misdemeanor punishable under Florida Statutes sections 775.082 or 775.083, with injured parties able to pursue civil action for compensatory and punitive damages, attorney fees, and costs.

• Takes effect July 1, 2012.
