HB 1369 Summary

• Deposits revenues from the Department of Revenue into the Water Protection and Sustainability Program Trust Fund in the Department of Environmental Protection, effective July 1, 2013.

• Revises the funding distribution formula to allocate: 65% for alternative water supply programs, 22.5% for best management practices and total maximum daily load programs, 10% for surface water restoration, and 12.5% for disadvantaged small community wastewater grants.

• Requires the Department of Environmental Protection to request return of all unencumbered funds every 24 months beginning June 30, 2013, for redistribution into the trust fund.

• Mandates legislative review of the Water Protection and Sustainability Program and funding formula prior to the end of the 2015 Regular Session to determine if revisions are needed.

• For fiscal year 2012-2013, establishes a special distribution providing $100 million to the Department of Environmental Protection for alternative water supply projects with remaining funds allocated: 50% for total maximum daily load programs, 25% for surface water restoration, and 25% for disadvantaged small community wastewater grants.
