HB 1463 Summary

• Local governments may adopt ordinances establishing energy zones where renewable energy producers can sell directly to new customers at mutually agreed prices without utility regulation.

• Renewable energy producers must pay utilities 1.5 cents per kilowatt-hour for energy produced and sold, except when using utility-approved interruptible rate structures.

• All renewable energy sold in energy zones must be produced and used within zone boundaries or sold through net metering to the utility grid at full avoided cost.

• The Public Service Commission must adopt rules governing interconnection requirements, rate-setting criteria, and facility notification procedures, and must submit biannual reports to the Legislature beginning October 1, 2013.

• Renewable energy producers and sellers are exempted from Public Service Commission economic regulation by amending the definition of "public utility" in Florida Statutes.
