HB 4103 Summary

• Eliminates the Minority Business Certification Task Force and removes requirements that the task force approve certification criteria and amend the statewide and interlocal agreement for minority business enterprise certification.

• Transfers responsibility for developing and adopting minority business enterprise certification criteria directly to the Department of Management Services.

• Modifies language regarding family transfer ownership restrictions, clarifying that transfers within immediate family groups to minority persons are deemed made for certification purposes and render such ownership invalid if combined family net assets exceed $1 million.

• Updates procedural language throughout to clarify that the Office of Supplier Diversity may require random reviews or audits of certified businesses as it deems appropriate, and requires reviews within 2 years for businesses receiving payments exceeding $100,000 in any one fiscal year.

• Effective date: July 1, 2012.
