HB 5511 Summary

• Creates the Division of Drugs, Devices, and Cosmetics within the Department of Business and Professional Regulation to assume regulatory authority over Chapter 499, Florida Statutes, transferred from the Department of Health.

• Terminates the Florida Drug, Device, and Cosmetic Trust Fund (FLAIR 20-2-173005) effective November 1, 2012, transferring all balances and revenues to the Professional Regulation Trust Fund with a separate account for the Drugs, Devices, and Cosmetics program.

• Changes regulatory references throughout Chapter 499 from "State Surgeon General" or "Department of Health" to "Secretary of Business and Professional Regulation" or "Department of Business and Professional Regulation" to reflect the transfer of authority.

• Updates bond payment requirements for prescription drug wholesale distributors to require bonds payable to the Professional Regulation Trust Fund instead of the terminated Florida Drug, Device, and Cosmetic Trust Fund.

• Repeals section 548.061, Florida Statutes, relating to report and tax requirements for pugilistic matches; takes effect July 1, 2012, except as otherwise specified.
