SB 290 Summary

• Prohibits abortions in the third trimester or after fetal viability except when necessary to prevent death or substantial irreversible impairment of a major bodily function of the pregnant woman, requiring certification by two physicians or documentation of medical emergency by one physician.

• Restricts abortion locations: third trimester/viability abortions must occur in hospitals only; all other abortions permitted only in hospitals, licensed abortion clinics, or physician's offices.

• Requires physicians performing abortions to complete 3 hours of annual ethics-related continuing education; mandates 24-hour waiting period before abortion with informed consent requirements including ultrasound with opportunity to view images.

• Establishes requirements for infants born alive during abortion attempts, including same legal rights as other newborns and requirement for second physician presence; prohibits partial-birth abortions except when necessary to save mother's life.

• Increases penalties for improper fetal remains disposal to first-degree misdemeanor; requires abortion clinics to post conspicuous notice prohibiting third trimester abortions; mandates Agency for Health Care Administration annual reporting of aggregate abortion statistics to Governor and Legislature.
