Operators of electronic-based game promotions offering prizes valued over $1 must comply with filing requirements, trust account or surety bond provisions, winner disclosure rules, and anti-coercion standards currently applied to promotions over $5,000.

Electronic game promotion operators must file game rules and prize lists with the Department of Agriculture and Consumer Services and establish a trust account or surety bond equal to the total prize value before launching the promotion.

Operators must provide certified winner lists to the Department of Agriculture and Consumer Services within 60 days of final winner determination, or alternatively publish winner information in a Florida newspaper of general circulation.

Local governments are authorized to adopt ordinances regulating electronic game promotions, including provisions for permitting, fees, fines, location restrictions, signage requirements, and security measures.

The act takes effect July 1, 2012.
