Permits for solid waste management facilities with approved leachate control systems are issued for 20-year terms (or shorter if requested), with existing permit fees adjusted accordingly for facilities applying or renewing permits on or after October 1, 2012.

Permits for facilities without approved leachate control systems may be renewed for 10-year terms if the facility has operated at the same site for at least 4.5 years and meets compliance conditions including no active violations, no assessment monitoring requirements, and current financial assurance compliance.

A solid waste landfill closure account is established within the Solid Waste Management Trust Fund to fund closing and long-term care of solid waste facilities that were permitted, had closure insurance, and are abandoned or ordered to close by the department.

Owners and operators of solid waste management facilities receiving waste after October 9, 1993 must provide financial assurance for costs of completing corrective actions required for violations of water quality standards, using the same mechanisms available for closure costs.

$2,888,460 in nonrecurring funds from the Solid Waste Management Trust Fund is appropriated to the Department of Environmental Protection for closing and long-term care of solid waste management facilities, effective upon the act becoming law.
