Eliminates the exemption allowing local governments to perform projects using their own services, employees, and equipment if approved by majority vote after a public meeting.

Renumbers the remaining exemption (previously item 10) to item 9, which permits non-competitive awards to private contractors when procedures are established in a pre-July 1, 1994 charter, ordinance, or resolution and approved by two-thirds governing board vote.

Requires two-thirds (instead of simple majority) governing board approval and at least 14 days advance public notice for non-competitive awards under the pre-1994 procedure exemption.

Adds requirements that non-competitive awards under the exemption must be justified by: a unique contractor currently under contract for affiliated work, or evidence that competitive bidding would jeopardize funding, materially increase costs, or create public hardship.

Effective July 1, 2012.
