SB 1374 Summary

• Creates the "Florida for Life Act" establishing legislative findings that human life begins at conception and declaring a compelling state interest in protecting fetal life from that point through birth.

• Prohibits induced abortion for any purpose as a first-degree felony; makes operating any facility or business providing abortion services a first-degree felony punishable by up to life imprisonment.

• Allows termination of pregnancy only when two physicians certify in writing it is necessary to prevent the patient's death or treat a life-threatening disease, or in medical emergencies with limited physician availability.

• Requires termination of pregnancy be performed by a physician only, with voluntary informed written consent from the patient (or parent/guardian for minors); requires physicians to provide information about adoption alternatives and a statewide list of volunteer adoption attorneys.

• Creates an alternative provision (s. 390.01117) that takes effect only if the primary abortion prohibition is declared unconstitutional, which prohibits termination after fetal viability (with narrower exceptions) and requires viability determinations and ultrasounds for pregnancies at 22 weeks or later.
