CS for SB 1458 - Revised Florida Arbitration Code

• Replaces the Florida Arbitration Code with the Revised Florida Arbitration Code, effective July 1, 2012, governing all arbitration agreements made after that date and earlier agreements if parties consent in writing.

• Establishes comprehensive arbitrator disclosure requirements, including mandatory disclosure of conflicts of interest and relationships before accepting appointment, with continuing obligations during proceedings; failure to disclose creates presumption of partiality.

• Expands arbitrator and arbitration organization immunity from civil liability to match judicial immunity; arbitrators cannot be compelled to testify about arbitration proceedings except in limited circumstances.

• Authorizes courts to order provisional remedies before arbitrator appointment and allows arbitrators to issue interim awards; permits discovery and depositions as determined appropriate by the arbitrator; allows arbitrator-ordered temporary relief.

• Excludes child custody, visitation, and child support disputes from arbitration; amends voluntary trial resolution procedures in section 44.104 to clarify appointment, procedures, and appeal standards; provides trial resolution judges may wear robes and use that title.
