SB 1470 - Repeal of Administrative Rules

• Amends s. 120.536, F.S. to establish that repealing a law automatically nullifies any rule that implements only that repealed provision, with the Department of State removing the rule from the Florida Administrative Code.

• Creates s. 120.555, F.S. establishing a summary removal process for rules no longer in effect, requiring the Department of State to request confirmation from agencies within 90 days, with failure to respond constituting acknowledgment the rule is no longer effective.

• Nullifies approximately 300 specific administrative rules adopted by five water management districts, the former Department of Commerce, former Department of Health and Rehabilitative Services, former Advisory Council on Intergovernmental Relations, and former Department of Labor and Employment Security.

• Requires the Department of Health to initiate rulemaking before July 1, 2013 to readopt or revise portions of certain nullified health-related rules, and requires the Department of Education to do the same for vocational rehabilitation rules.

• Takes effect 60 days after becoming law, with nullified rules treated as repealed for all future editions of the Florida Administrative Code.
