Pecans that fall onto public rights-of-way from privately-owned pecan trees remain the property of the tree owner.

Removing pecans from public rights-of-way without the tree owner's permission is prohibited and constitutes a second-degree misdemeanor.

Removing pecans from a privately-owned pecan tree or causing pecans to fall from such a tree without the owner's permission is prohibited and constitutes a second-degree misdemeanor.

Violations are punishable according to Florida Statutes sections 775.082 and 775.083.

The act takes effect July 1, 2012.
