Employers may voluntarily elect to guarantee tipped employees receive wages, including tips, equal to at least 130 percent of the state minimum wage rounded up to the next cent

Employers must make the election in writing, dated, and prominently display it in a conspicuous, accessible place on the premises for at least one year before revocation is allowed

Employers who fail to pay the guaranteed wage or engage in discriminatory or retaliatory actions are subject to civil actions and fines under section 448.110, Florida Statutes

Employers paying the guaranteed wage are deemed to have fulfilled state minimum wage obligations, though the bill does not affect federal Fair Labor Standards Act compliance requirements
