Creates section 768.1258 in Florida Statutes to provide liability protection for manufacturers, sellers, and suppliers of qualified portable consumer fuel containers that meet ASTM standards F852-08, F839-06, F2517-09, F926-07, or F976-08.

Shields manufacturers, sellers, and suppliers from liability for injury, death, or property loss arising from misuse of qualified fuel containers, including use to ignite or accelerate fires.

Defines "misuse" as use inconsistent with container specifications and standards, contrary to manufacturer warnings, or deemed improper by federal or state consumer safety agencies.

Removes liability immunity if the manufacturer, seller, or supplier intentionally misbranded the container or knowingly and willfully violated state or federal law regarding the container.

Awards reasonable attorney fees and costs to parties prevailing on motions to dismiss actions under this statute; effective July 1, 2013.
