CS/HB 301 Summary: Cancer Treatment Fairness Act

• Requires individual and group insurance policies and health maintenance contracts that cover cancer treatment medications to also cover orally administered cancer treatment medications at parity with intravenous or injected cancer treatments.

• Prohibits insurers and health maintenance organizations from varying policy terms, providing incentives to avoid compliance, penalizing practitioners, or reclassifying intravenous/injected medications to circumvent the parity requirement.

• Allows cost-sharing for oral cancer medications up to $50 per month if intravenous or injected medications cost less than $50 per month; otherwise, cost-sharing must be equal.

• Excludes grandfathered health plans from all coverage and cost-sharing requirements under the act.

• Effective January 1, 2015, and applies to policies and contracts issued or renewed on or after that date.
