CS/HB 311 Summary

• Court clerks must withhold sufficient funds from cash bonds posted by criminal defendants to pay unpaid prosecution costs, representation costs, court fees, court costs, and criminal penalties, with any remaining funds returned to the defendant.

• Cash bond forms must prominently display notice that all funds are subject to forfeiture and withholding for payment of prosecution costs, representation costs, court fees, court costs, and criminal penalties regardless of who posted the bond.

• Juveniles adjudicated delinquent or with adjudication withheld shall be assessed costs of prosecution under section 938.27, with the option to perform community service in lieu of costs if unable to pay.

• Investigative costs recovered must be returned to the appropriate investigative agency; state attorney costs must be set at minimum $50 per misdemeanor case and $100 per felony case, deposited into the State Attorneys Revenue Trust Fund.

• The act takes effect July 1, 2013.
