HB 659 Summary: Fossil Fuel Combustion Products

• Creates section 403.7047 to establish standards for storage and beneficial use of fossil fuel combustion products (fly ash, bottom ash, boiler slag, flue-gas emission control materials) from electric and steam generation facilities.

• Defines "beneficial use" to include asphalt, concrete, cement products, structural fill, pavement aggregate, and other uses meeting specified criteria, exempting these uses from hazardous waste disposal regulations if they do not violate air or water quality standards.

• Requires fossil fuel combustion products destined for beneficial use to comply with department rules and be conducted in a manner that does not pose a significant risk to public health or violate applicable environmental standards.

• Amends section 403.7222 to exclude disposal facilities accepting fly ash, bottom ash, boiler slag, or flue-gas emission control materials from fossil fuel-fired electric or steam generation facilities from hazardous waste landfill restrictions.

• Takes effect July 1, 2013.
