CS/CS/HB 743 Summary

• Creates the "Fracturing Chemical Usage Disclosure Act" establishing section 377.45, Florida Statutes, requiring the Department of Environmental Protection to designate or establish an online hydraulic fracturing chemical registry.

• Designates the Chemical Disclosure Registry (FracFocus.org), developed by the Groundwater Protection Council and Interstate Oil and Gas Compact Commission, as the state's official registry with a link provided through the department's website.

• Requires service providers, vendors, and well owners/operators to report total water volume used, each chemical ingredient subject to federal OSHA standards (29 C.F.R. s. 1910.1200(g)(2)), and ingredient concentration by mass within 60 days after hydraulic fracturing operations initiate.

• Excludes from disclosure requirements any ingredients not purposefully added to the hydraulic fracturing treatment or that occur incidentally or unintentionally in the treatment.

• Authorizes the Department of Environmental Protection to adopt rules to administer the registry requirements and takes effect July 1, 2013.
