Exempts trade secrets relating to hydraulic fracturing treatments held by the Department of Environmental Protection from public records disclosure if the submitter requests confidentiality, provides basis for the claim, and marks documents as "trade secret"

Requires the department to notify the trade secret submitter within 30 days of receiving a public records request for marked documents, allowing the submitter 30 days to file a circuit court action to prevent disclosure; failure to file within 30 days constitutes waiver of confidentiality

Permits disclosure of confidential trade secrets to other governmental entities performing statutory duties and to parties involved in proceedings under the statute, with all participants required to maintain confidentiality

Automatically repeals the exemption on October 2, 2018, unless the Legislature reviews and reenacts it under the Open Government Sunset Review Act

Takes effect contingent upon HB 743 or similar legislation taking effect in the same 2013 legislative session
