Division of Hotels and Restaurants must adopt risk-based inspection frequency rules for licensed public food service establishments by July 1, 2014.

Public lodging establishments must be inspected at least biannually, except transient and nontransient apartments which must be inspected at least annually.

Food service establishments must receive between 1-4 routine inspections annually, with rules that may consider compliance history, type of food preparation, and type of service.

Division must annually reassess inspection frequency for all licensed public food service establishments.

When inspectors identify vulnerable adults as victims of neglect or tenants unable to self-preserve in emergencies during lodging inspections, the division must convene meetings with relevant agencies to develop safety improvement plans.
