CS/CS/HB 807 - Emergency Communication System Summary

• Amends the E911 emergency communications system by establishing a prepaid wireless E911 fee collected at point of sale, effective November 1, 2013, at 43 cents per retail transaction, with sellers retaining 100 percent of collections for 2 months to offset setup costs.

• Creates a three-category E911 System Fund structure (wireless, nonwireless, and prepaid wireless) with specific distribution percentages: 67 percent of wireless category to counties, 97 percent of nonwireless category to counties, and 61 percent of prepaid wireless category to counties based on fees reported.

• Sets the standard E911 fee at 43 cents per month per service identifier effective January 1, 2014, with a maximum cap of 50 cents, and allows the E911 Board to adjust the fee rate after January 1, 2015, with two-thirds board approval.

• Requires the Department of Revenue to serve as the collection agent for prepaid wireless E911 fees, retaining up to 3.2 percent of funds to reimburse direct administrative costs, with sellers registering with the department and filing monthly or quarterly returns.

• Provides exemptions making state and local governments non-consumers for fee purposes and prohibiting local governments from imposing additional fees on E911 service providers or sellers, while appropriating $500,000 to the Department of Revenue for fiscal year 2013-2014.
