CS/HB 841 - Powers of Attorney

• Authorizes a notary public to sign a principal's name on a power of attorney document if the principal is physically unable to sign, pursuant to section 117.05(14).

• Allows an original power of attorney to be recorded in official records upon payment of applicable service charges.

• Permits third persons to require agents to execute affidavits regarding the principal's status and the agent's authority, and requires third persons who reject a power of attorney to provide written reasons for rejection.

• Adds exceptions to provisions prohibiting agent delegation, allowing delegation under sections 518.112 and for government forms, and authorizes notaries to sign enumerated authorities if principal is physically unable.

• Grants broker-dealers immunity from liability for actions taken in good faith reliance on an agent's authority and specifies that agents have general authority regarding securities held by broker-dealers when properly authorized in the power of attorney.
