First violation of operating without required license is a first-degree misdemeanor; second or subsequent violation is a third-degree felony with civil penalty up to $10,000.

Impersonating a licensed security officer, investigator, or recovery agent while forcing another person to assist is a third-degree felony; increases to second-degree if during a felony, or first-degree if resulting in death or serious bodily injury.

Licensed security officers and managers with valid Class "D," "MB," and "G" licenses may temporarily detain persons on critical infrastructure facilities if they have probable cause to believe a crime is occurring, but must notify law enforcement and transfer custody upon officer arrival.

Security officers may search a detained person only if armed with firearm, concealed weapon, or destructive device posing threat, and must seize any weapons found and transfer to law enforcement.

Law enforcement officers and licensed security personnel have immunity from criminal or civil liability for false arrest, false imprisonment, or unlawful detention if acting in compliance with this section; effective date July 1, 2013.
