Fire officials must enforce Florida Building Code wall fire-rating provisions for occupancy separation in one-story or two-story structures less than 10,000 square feet classified as business or mercantile occupancies.

Structures located on agricultural property that are part of farming or ranching operations are exempt from the Florida Fire Prevention Code, including national codes and Life Safety Code incorporated by reference.

Agricultural structure exemption applies only when occupancy is limited to no more than 35 persons and the structure is not used by the public for direct sales or as an educational outreach facility.

Agricultural structure exemption does not apply to structures used for residential or assembly occupancies as defined in the Florida Fire Prevention Code.

The act takes effect July 1, 2013.
