CS/CS/HB 1021 - Background Screening

• Allows the Department of Highway Safety and Motor Vehicles to share driver license photographs with the Agency for Health Care Administration to verify photographs in the Care Provider Background Screening Clearinghouse.

• Adds five new disqualifying offenses for background screening purposes: attempts/solicitation/conspiracy to commit listed offenses, obtaining goods with false credit cards (felony), fraudulently obtaining goods/services from health care providers, racketeering and illegal debts, and money laundering.

• Requires individuals seeking exemption from disqualification to have completed all nonmonetary conditions imposed by the court and paid any court-ordered monetary penalties in full before being eligible to apply.

• Requires a photograph of the person taken at the time fingerprints are processed to be submitted to the Care Provider Background Screening Clearinghouse before electronic fingerprint submission.

• Requires employers to register with the clearinghouse and include employee information (full name, social security number, date of birth, mailing address, sex, and race) before referring employees for fingerprint submission to the Department of Law Enforcement.

• Effective date: July 1, 2013.
