CS/HB 1041 Summary

• Adds six new substances to Schedule III controlled substances: Human chorionic gonadotropin (hCG), CJC-1295, Growth hormone releasing hormone (GHRH), Growth hormone releasing hexapeptide (GHRP-6), Human growth hormone (HGH), Somatropin, and Tesamorelin that promote muscle growth or enhance athletic performance.

• Reenacts criminal prohibitions in section 893.13 to incorporate the new Schedule III substances into existing penalties for possession, sale, manufacture, and delivery of controlled substances.

• Updates the Criminal Punishment Code offense severity ranking chart to reflect penalties for violations involving the newly scheduled substances.

• Maintains existing penalty structures where violations involving these substances trigger third-degree felony charges for possession, manufacturing, or delivery (consistent with other Schedule III drugs).

• Effective date: October 1, 2013.
