CS/HB 1339 - Residential Properties

• Allows condominium associations to enter abandoned units without owner authorization to inspect, repair, prevent mold/deterioration, and maintain common elements, with 48-hour notice required except in emergencies.

• Expands liability for unit owners acquiring title (including through foreclosure) to include joint and several liability with previous owners for unpaid assessments, late fees, interest, and reasonable attorney fees incurred in collection.

• Limits first mortgagees acquiring title through foreclosure to liability of the lesser of: only assessments from the preceding 12 months or one percent of the original mortgage debt, provided the association was joined as a defendant in the foreclosure action.

• Authorizes homeowners' associations to print and distribute member directories containing names, parcel addresses, and telephone numbers, with owners able to exclude their telephone numbers by written request.

• Takes effect July 1, 2013.
