HB 1343 Summary: Universal Background Check Act

• Requires all firearm transfers between private parties to be conducted through a licensed dealer, including internet sales, unless one party is already a licensed dealer.

• Licensed dealers must retain possession of firearms during transfers, conduct background checks complying with federal and state law, and observe all applicable waiting periods before delivery.

• If a transfer is prohibited by law, dealers must return the firearm to the seller; if return is also prohibited, dealers must deliver the firearm to the county sheriff within 24 hours.

• Dealers may charge a fee to purchasers covering administrative costs plus applicable federal and state fees.

• Exempts law enforcement, gunsmiths, transportation carriers, target shooting loans, hunting/recreational loans, temporary family member possession (up to 14 days), and inheritance transfers; violations constitute a third-degree felony.

• Effective October 1, 2013.
