HB 1353 - Ticket Sales Summary

• Enhanced criminal penalties for fraudulent ticket creation or possession, including felony charges for second violations and for possessing 10 or more fraudulent tickets, with fines up to $10,000

• Requires ticket brokers to register with the Department of Agriculture and Consumer Services by April 1, 2014, maintain a Florida business address, and certify they do not use software designed to interfere with ticket sellers

• Mandates ticket brokers and resale websites disclose face value, seat location, ticket possession status, and prohibits them from using website URLs containing trademarks without the owner's written consent

• Establishes criminal and civil penalties including treble damages for violating ticket resale restrictions, and prohibits intentional use of software to circumvent ticket seller security measures

• Defines admission tickets as revocable licenses and clarifies that initial ticket sales are unaffected by resale restrictions; effective October 1, 2013
