HB 7017 Summary

• Repeals statutes establishing fixed court terms for the Florida Supreme Court, district courts of appeal, circuit courts, and all 20 judicial circuits, as well as requirements for judges to attend the first day of each term and related penalties.

• Creates section 43.43 authorizing the Supreme Court to establish, delegate, or eliminate court terms for all court levels at its discretion.

• Creates section 43.44 allowing appellate courts to recall and modify their own mandates within 120 days of issuance.

• Amends multiple statutes (sections 26.46, 27.04, 30.12, 30.15, 34.13, 35.05, 38.23, and others) to remove references to "terms of court" and replace them with "sessions" where applicable to conform with the elimination of fixed court terms.

• Takes effect January 1, 2014.
