CS/CS/HB 7083 - Timely Justice Act of 2013

• Shifts funding for court-appointed attorneys in death penalty clemency proceedings from the Department of Corrections to the Justice Administrative Commission.

• Repeals the pilot program using registry attorneys for capital collateral counsel services in Florida's northern region and establishes a permanent regional counsel office instead.

• Prohibits attorneys from representing capital defendants in specified proceedings for 5 years if they provided constitutionally deficient representation in two separate capital postconviction cases where relief was granted.

• Establishes a public records repository managed by the Secretary of State and requires state attorneys, law enforcement, corrections, and other agencies to submit case records within 90 days after the Florida Supreme Court affirms a death sentence.

• Allows the Governor to issue execution warrants within 30 days of receiving certification from the Florida Supreme Court clerk that all appellate and postconviction remedies have been exhausted, with execution to occur within 180 days.
