Palm Beach County is authorized and directed to appropriate and pay $100,000 to Javier Soria as compensation for injuries sustained in an April 17, 2007 motorcycle accident caused by a negligent Palm Beach County dump truck operator.

Javier Soria suffered severe injuries including subarachnoid hemorrhage, right elbow fracture, deep lacerations, and multiple orthopedic and neurological injuries requiring numerous surgeries and ongoing treatment.

Medical experts assigned Soria a 34 percent neurological impairment rating and 53 percent orthopedic disability rating, with total economic damages exceeding $1.3 million including approximately $200,254 in past medical expenses and $640,000 in future medical expenses.

The $100,000 payment combined with any amounts paid under Florida Statutes section 768.28 shall be the sole compensation for all present and future claims against Palm Beach County arising from this accident.

Attorney fees, lobbying fees, costs, and similar expenses related to this claim may not exceed 25 percent of the total amount awarded under the act.
