Creates the "Florida Ban on Communicating While Driving Law" prohibiting drivers from manually typing into hand-held wireless devices or reading/sending data for nonvoice communication (texting, emailing, instant messaging).

Prohibits operating a motor vehicle while using a hand-held wireless device unless it is specifically designed for hands-free listening and talking.

Provides exceptions for emergency personnel performing official duties, reporting emergencies, receiving navigation or safety alerts, using navigation systems, and conducting voice communications without manual text entry.

Establishes violations as noncriminal traffic infractions, with second or subsequent violations within 5 years treated as moving violations; allows billing records and witness testimony as admissible evidence.

Assigns 6 points to driver licenses for unlawful hand-held wireless device use resulting in a crash and 2 points for such violations within school safety zones; effective October 1, 2013.
