Requires that an advisory sentence of death in capital felony and capital drug-trafficking felony cases must be made by unanimous jury recommendation, effective for offenses committed on or after October 1, 2013.

Mandates court instruction to the jury that to recommend the death penalty, they must find sufficient aggravating circumstances that outweigh any mitigating circumstances.

Requires court instruction that each aggravating circumstance supporting a death recommendation must be proven beyond a reasonable doubt by a unanimous jury vote.

Requires courts to provide a special verdict form for each aggravating circumstance found by the jury.

Changes statutory language from "a majority of" the jury's recommendation to removal of that phrase, eliminating prior majority-vote requirement for death penalty recommendations.
