Allows wine to be sold in reusable containers holding 5.16 gallons, creating an exception to the previous maximum allowable capacity of 1 gallon for individual wine containers in Florida.

Permits qualified distributors and manufacturers to continue selling wine in any size containers when selling to other qualified distributors or manufacturers.

Requires all wine sold or offered for sale by licensed vendors for off-premises consumption to be in unopened original containers, with exceptions as provided in section 564.09.

Changes the penalty language from "shall be guilty of" to "commits" a misdemeanor of the second degree for violations of wine container size restrictions.

Takes effect July 1, 2013.
